Laundry Care Express is pleased to provide laundry service to you ("you" or the "customer"), subject to your acceptance and compliance with the Terms of Use set forth below. Please read the following provisions carefully. Your use of the Laundry Care Express website and service indicates your agreement to be bound by the Terms of Use contained herein. If you do not so agree, you must immediately cease using the Laundry Care Express website and service.

 

Laundry Care Express reserves the right, from time to time, with or without notice to you, to change these Terms of Use. The most current version of these Terms of Use can be reviewed by clicking on "Terms of Use" located at the footer of any page in the Laundry Care Express website. The most current version of the Terms of Use will supersede all previous versions. Your use of the Laundry Care Express website or continued use of our service after changes are made means that you agree to be bound by such changes. As such, you should review the Terms of Use periodically.

 

This agreement is strictly between Laundry Care Express and its customers and does not in any way constitute or imply any relationship with any other parties. The term "Laundry" may be used to include wash & fold laundry (normal machine washable items), dry cleaning, and dress shirt laundry.
 

Pickup & Delivery

Laundry and/or dry cleaning pickups must be scheduled in advance by the customer. With the exact available pickup and delivery days depending on your service area (this information is shown in the website where you set up your schedule), pickup and delivery generally takes place each week on Monday through Friday, except on certain holidays determined by Laundry Care Express. Laundry Care Express reserves the right to determine the pickup and delivery times, normally between 8 a.m. and the evening hours depending on our laundry volumes and the most efficient routing of pickup and delivery vehicles.

 

Laundry Care Express may provide the customer with Laundry Care Express bags marked " Laundry" and/or marked "Dry Cleaning/Dress Shirt Laundry" upon customer's first delivery of these separate services. For their first pickup and other occasions where the customer does not have the appropriate Laundry Care Express bag(s), the customer should SEPARATE THEIR WASH & FOLD LAUNDRY FROM THEIR DRY CLEANING/DRESS SHIRT LAUNDRY (dry cleaning and dress shirt laundry may be mixed and should be bagged together) and use plastic trash bags, pillow cases, or the like and LABEL EACH BAG "LAUNDRY" OR "DRY CLEANING/DRESS SHIRT LAUNDRY". Regardless of the bag(s) used, the customer agrees to always separate wash & fold laundry from dry cleaning/dress shirt laundry into separate bags and identify the bags "LAUNDRY" or "DRY CLEANING/DRESS SHIRT LAUNDRY". If no identifying labels are found, Laundry Care Express reserves the right to wash & fold launder or dry clean the items at its sole discretion.

 

The customer agrees not to include any of the following that are in or attached to any of the items to be cleaned or inside any of the customer's laundry bags: (i) non-washable items, (ii) items that are labeled for hand washing only, or (iii) any other items not meant for laundering or dry-cleaning. The customer is responsible for any and all damage caused by any items left in the customer's clothing or laundry bag that cause damage to the clothing of any customer, the cleaning machines, or any other property of Laundry Care Express or its customers.

 

Laundry Care Express is not responsible for, and shall not pay for, any loss, damage or theft of items left unattended by the customer for pickup or delivery. The customer grants Laundry Care Express personnel access to their pickup and delivery location and will exonerate, hold harmless, protect, and indemnify Laundry Care Express, its employees, its successors, and assigns, from and against any and all loss, liabilities, damages, claims, suits, or actions, judgments, and costs which may arise from intentional acts, omissions, or negligent acts. The customer will restrain owned animals so they are not a danger to Laundry Care Express personnel or have an opportunity for escape as a result of the driver's access and failure to close doors, gates, etc.


Missed Pickup or Delivery

If the customer misses a scheduled pickup (no laundry available for pickup) or a scheduled delivery (if the customer is not at their address and they have instructed us not to leave laundry unless they are present), a $9.99 missed pickup/delivery fee may apply, plus other amounts normally charged for distant or hard to service locations. There is no fee for pickups that are canceled before 9 am the day of the pickup.


Garment Care

Laundry Care Express will use reasonable efforts to maintain a high quality laundering and cleaning service. Laundry Care Express accepts no liability for for items treated in accordance with the care labels or other instructions provided; or for damage to items without care instructions or care instructions that are obscured or not easily seen. Laundry Care Express accepts no liability for laundering of dry cleaning items that the customer has placed in bags labeled for laundry or wash & fold laundry; or for dry cleaning of laundry items that the customer has placed in bags labeled for dry cleaning and shirt laundry (higher dry cleaning charges may apply).  Laundry Care Express accepts no liability for items that require special attention to be cleaned; however, as possible and at the discretion Laundry Care Express, we will take special care of these items if they are placed in a separate plastic bag (provided by the customer) located within the customer's laundry bag and clearly labeled with instructions. Laundry Care Express is not responsible for items bleeding, shrinking, or otherwise changing as a result of normal processing. Precautions will be taken to alleviate these problems if possible. Laundry Care Express reserves the right to refuse to clean any garment. Laundry Care Express does not guarantee the removal of all stains. Laundry Care Express will re-clean items that, in its sole discretion, were not properly cleaned and have not been worn or used since they were cleaned. 


Prohibited Items

The customer warrants that they will not give Laundry Care Express any items contaminated with solvents, chemicals, or cleaning products. The customer is responsible for any and all damage these cause to the clothing of any customer, the cleaning machines, or any other property of Laundry Care Express or its customers. Laundry Care Express will not clean items that contain solid animal or human feces.


Lost Items

In the event of missing items sent for wash & fold laundry, Laundry Care Express assumes no responsibility for their loss. We take great care to insure that wash & fold laundry is positively contained to prevent its loss. Customers are often unaware of the exact contents of their wash & fold laundry bag, only having a suspicion that a lost item was included in the bag. It's natural that customers blame the laundry service, then common for them to find the item within their household or business in the following weeks. Wash & fold laundry is a bulk service that does not identify each item separately, so even if the customer includes an inventory list, it will not be noted.

 

In the event of missing items sent for dry cleaning item or dress shirt laundry, Laundry Care Express will assume responsibility only for items counted as received and entered into our inventory system.  For these items, we will issue you a refund or credit for the item, as specified in the International Fair Claims Guide from the International Fabricare Institute ("IFI") and as otherwise stated in these Terms of Use for damaged items, below.


Damaged Items

In the event that a wash & fold, dry cleaning, or a dress shirt item is damaged by Laundry Care Express, we will issue you a refund or credit for the value of that item, as specified in the International Fair Claims Guide from the International Fabricare Institute ("IFI") or as otherwise stated in these Terms of Use. The Fair Claims Guide takes into account the average life of the garment, depreciation for the age of the item, and the current replacement cost. If the customer is unable to document the age of a garment, the customer can attest to the age but Laundry Care Express, in its sole discretion, may limit the minimum age of any garment to one year. If no current replacement cost is available (e.g., because the item is no longer available in stores), Laundry Care Express may use the replacement cost of a comparable item currently available. Notwithstanding the foregoing, the maximum reimbursement for each individual item is thirty dollars ($30.00) not to exceed the lesser of one hundred fifty dollars ($150.00) per order or twenty five dollars ($25.00) for every ten (10) pounds of wash & fold laundry washed and is subject to standard depreciation schedules as spelled out in the Fair Claim Guide from the International Fabricare Institute ("IFI"). The limit to this policy is three hundred dollars ($300.00) per customer per year. Although Laundry Care Express is not liable for damage or loss due to the fault of third-party service providers, we may, in our sole discretion, chose to reimburse the customer in these events pursuant to the IFI standards described above.

 

We are not liable for any preexisting damage to garments or other laundry items. If we find any preexisting damage or have a concern about the colorfastness, or the age or weakness of the fabric, we may process it at our discretion on a best efforts basis. Or, we may return the item without cleaning it.  In addition, items which are purposely torn, distressed, or damaged by the manufacturer (e.g. jeans, denim garments, etc.), can not be included in any damage claim.

 

Laundry Care Express is not responsible for the loss or damage to any personal or non-cleanable item(s) left in clothing, washable items, or pickup or delivery bags such as money, jewelry, or other items.  Laundry Care Express is also not responsible when such items (and including ink pens, markers, pencils, crayons, lip balm, etc.) result in damage to items during our processing.  While we try to detect and remove these items before processing, you agree not to leave such items in your laundry, dry cleaning, dress shirt, or pickup or delivery bags.

 

Missing or damaged items must be reported to us within forty-eight (48) hours of delivery of the item(s).


Pricing

Laundry Care Express reserves the right to change prices at any time and is not responsible for typographical errors on the website related to pricing information. We will inform you if a typographical error has resulted in a difference in pricing for your order before charging your credit card.  Laundry Care Express reserves the right to reasonably modify its pricing without notice for items that are either very light-weight when dried (dry weight does not fairly represent laundering value), items that are very absorbent in comparison to standard fabrics (may require extended drying time), or other items that Laundry Care Express judges to be unusual.

 

A minimum charge applies for wash & fold laundry ($24.99) and dry cleaning/dress shirt laundry ($24.99, waived if accompanied by wash & fold laundry). This helps us efficiently launder and pickup/deliver laundry.


Payment

Payment is accepted by debit or credit card. To schedule service the customer must have an active debit or credit card entered into the Laundry Care Express website or, with prior arrangement and at the sole discretion of Laundry Care Express, certain customers (e.g. high-volume commercial customers) may be granted payment terms.  Payments for completed services are non-refundable.  In the event that Laundry Care Express is unable to authorize the customer's credit card for payment or the customer has invoices outstanding beyond the agreed on payment terms, laundry maybe held until payment for current and prior services is received.  Alternately and in its sole discretion, Laundry Care Express drivers may accept cash on delivery (COD) payments with an additional fee equal to the amount charged by UPS (as of October 2017 this is $12.90).  It is the customer's responsibility to make sure they are given proof of payment by the driver and they should retain this record in case it is required to resolve payment questions.


Use of Third-Party Service Providers

Laundry Care Express reserves the right to utilize any vendor or outside service provider, for any service, in its sole discretion, without notice to the customer.


User ID and Password

Access to the Laundry Care Express website is granted through the use of your email address and a password that you will select upon registration. You are solely responsible for any authorized or unauthorized access to your account by any person. You agree to bear all responsibility for the confidentiality of your password and all use or charges incurred from use of the Laundry Care Express website with your password. You agree to notify Laundry Care Express promptly of any unauthorized use of your password and you will remain liable for any use of the Laundry Care Express website until Laundry Care Express blocks access with this password.


Your Account

You are responsible for, and agree to pay promptly, all charges to your account, including applicable taxes and purchases by you or anyone you allow to use your account and password to access the Laundry Care Express website. You agree and accept responsibility for keeping all your account information current, including address, payment information, telephone number, and e-mail address. You can and are urged to update your information on our website. You agree that you will not provide fraudulent information and that you are solely responsible for any information you provide to Laundry Care Express, and accept responsibility for all activities that occur under your account or password and for restricting access to your computer. You will comply with all laws applicable to your activities on the website and with this Agreement. Laundry Care Express' secure server encrypts your credit card information so that it cannot be read as the information travels over the Internet.


Text Messages and Automated Telephone Calls

If you opt-in on your Account Information page, we may send you multiple text messages and automated telephone calls with important information about your laundry orders (e.g. , expired credit cards, order status, etc.).  Message and data rates may apply.  You can opt-out anytime by unchecking the appropriate box at https://www.laundrycareexpress.com/account (you must be logged into your account to use this link).  Additionally, please see our privacy policy at https://www.laundrycareexpress.com/privacy-policy.


Copyright and Ownership

All website content, design, text, graphics, and interfaces; the collection, selection, and arrangement thereof; and all software are the property of, or duly licensed to, Laundry Care Express. Consent is granted to view, electronically copy, and print in hard copy portions of this website for the sole purpose of placing an order. Any other use of materials on this website, including modification, distribution, or reproduction for purposes other than those noted above, without the prior written permission of Laundry Care Express is strictly prohibited. You acknowledge that Laundry Care Express and/or third-party content providers remain the owners of such material and that you do not acquire any of those ownership rights by downloading copyrighted material. Laundry Care Express reserves the right to revoke this authorization at any time, and any use shall be discontinued immediately on written notice from Laundry Care Express.


Trademarks

"Laundry Care Express," and its logo are federally registered tradmarks (R).  "www.laundrycareexpress.com," "picking up laundry... delivering freedom", all related logos, and all titles, characters, names, graphics, and button icons are service marks, trademarks and/or trade dress of Laundry Care Express or otherwise proprietary to Laundry Care Express and may not be used by you for any reason other than as expressly permitted by this Agreement. All other trademarks, service marks, product names, and company names or logos appearing in connection with Laundry Care Express and on the website are the property of their respective owners and you do not acquire any ownership rights in such marks, logos, or names by using this website or any Laundry Care Express services.


Disclaimer

Laundry Care Express liability shall be limited to general money damages in a maximum amount not to exceed one hundred fifty dollars ($150.00). This liability shall be the extent of Laundry Care Express' liability regardless of the form in which any legal or equitable action may be brought and the foregoing shall constitute the customer's exclusive remedy. In no event will Laundry Care Express be held liable or be responsible for any consequential, special, indirect, incidental or punitive loss or damages, whether or not Laundry Care Express knew or should have known of the likelihood of any such loss or damages. Laundry Care Express disclaims all warranties, express or implied, with respect to the services rendered to the customer.


Venue and Choice of Law

Any suit involving any dispute arising between Laundry Care Express and the customer may only be brought in the County of Santa Cruz in the California State Court or United States Federal Court having jurisdiction over the subject matter of the dispute or matter and that is in, or the shortest distance from, Santa Cruz, California.  These terms of service and the relationship between the parties shall be interpreted, construed, and governed according to the internal laws of the State of California, without reference to its choice of law rules.

What information do we collect?

We collect information from you when you register on our site or when you talk to one of our repesentatives.

When ordering or registering on our site, as appropriate, you may be asked for your: name, e-mail address, mailing address, phone number and credit card information. You may, however, visit our site anonymously.


What do we use your information for?

How do we protect your information?

We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information.

 

We use a secure server. All credit card information is encrypted and transmitted via Secure Socket Layer (SSL) technology.  This information is received into our secure payment gateway provider's database and is only accessible by those authorized with special access rights to such systems and who are required to keep the information confidential.

After a transaction, your private information (credit cards, social security numbers, financials, etc.) will be kept on file for more than 60 days in order to make it quick and easy for you to schedule and pay for future services.


Do we use cookies?

Yes (cookies are small files that a site or its service provider transfers to your computer's hard drive through your web browser (if you allow) that enables the sites or service providers systems to recognize your browser and capture and remember certain information).

We use cookies to understand and save your preferences for future visits and compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future.
